Scope of application

Article 1

1.
Accommodation contracts and related contracts that our hotel concludes with guests shall be in accordance with the provisions of these terms and conditions, and matters not stipulated in these terms and conditions shall be subject to laws and regulations (or those based on laws and regulations). (hereinafter the same shall apply) or in accordance with generally established custom.
2.
If the Hotel accepts a special agreement to the extent that it does not violate laws, regulations, etc. or customs, that special agreement shall take precedence, regardless of the provisions of the preceding paragraph.

Application for accommodation contract

Article 2

1.
A person who wishes to apply for an accommodation contract with this hotel must provide the following information to the hotel.

(1) Name of guest and contact information of guest
(2) Accommodation date and estimated time of arrival
(3) Accommodation charges (as a general rule, according to the basic accommodation charges in attached table 1)
(4) Other matters deemed necessary by the hotel
2.
If a guest requests to continue staying beyond the accommodation date specified in item 2 of the preceding paragraph during their stay, the hotel will treat the request as having been applied for a new accommodation contract at the time the request is made. .

Establishment of accommodation contract, etc.

Article 3

1.
The accommodation contract shall be concluded when the hotel accepts the application set forth in the preceding article. However, this does not apply if the hotel proves that it has not consented.
2.
When an Accommodation Contract has been established in accordance with the provisions of the preceding paragraph, an application fee set by the Hotel, within the limits of the basic accommodation charges for the entire stay (if the stay exceeds 3 days, then 3 days), shall be paid by the date specified by the Hotel.
3.
The application fee will first be applied to the accommodation fee that the guest will ultimately have to pay, and in the event that the provisions of Articles 8 and 20 apply, the application fee will be applied to the cancellation fee and then to the compensation. If there is any remaining amount, it will be returned at the time of payment of fees pursuant to Article 14.
4.
If the application fee set forth in Paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same paragraph, the Accommodation Contract shall become invalid. However, this only applies if the hotel notifies the guest of this fact when specifying the due date for payment of the application deposit.

Special agreement that does not require payment of application fee

Article 4

1.
Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may accept a special agreement in which the payment of the application fee set forth in the same paragraph is not required after the conclusion of the contract.
2.
If the hotel does not request the payment of the application deposit as set forth in Paragraph 2 of the preceding article or does not specify the payment date for the application deposit when accepting an application for an accommodation contract, it will be treated as acceptance of the special agreement set forth in the preceding paragraph. Request for cooperation in infection prevention measures at facilities

Article 5

Our hotel may request the cooperation of those who wish to stay in accordance with the provisions of Article 4-2, Paragraph 1 of the Inns and Hotels Act (Act No. 138 of 1948).

Prohibited matters for guests, etc.

Article 6

1.
Guests may not allow non-guests to stay at the hotel, transfer or resell their status under the accommodation contract, or allow non-guests to use the guest-only facilities within the hotel without the prior consent of the hotel. shall not occur.
2.
The hotel may contact the contact information provided in accordance with Article 2, Paragraph 1 to confirm the reservation or make other communications on any day prior to the scheduled stay date. In that case, the Guest shall respond to the prior communication from the Hotel unless there are unavoidable circumstances.

Refusal to conclude an accommodation contract

Article 7

1.
The hotel may not accept the conclusion of an accommodation contract in the following cases: However, this paragraph does not mean that our hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.


(1) When the application for accommodation does not comply with these terms and conditions.
(2) When there are no rooms available due to full occupancy.
(3) When it is deemed that there is a risk that the person seeking accommodation may engage in acts that violate laws and regulations, public order, or good morals regarding accommodation.
(4) When the person seeking accommodation is a patient, etc. of a specified infectious disease, etc., as stipulated in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act (hereinafter referred to as "Patient, etc. of a specified infectious disease").
(5) When the Hotel is unable to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable reasons.
(6) When the person seeking accommodation falls under any of the following ① to ⑦.

① Organized crime groups, companies/organizations related to organized crime groups, corporate racketeers, extremist action groups, special intelligence violent groups, quasi-organized groups, other criminal groups, other anti-social forces, or persons equivalent to these (hereinafter referred to as "organized crime groups, etc.") Or if you are affiliated with an organized crime group, etc.
② If the organized crime organization or a person related to an organized crime organization is a corporation or other organization that controls business activities.
③ In the case of a corporation whose officers (referring to directors, executive officers, or similar persons), employees, affiliated companies, etc. are affiliated with organized crime groups, etc.
④ If the person allows his/her name to be used by organized crime groups, etc.
⑤ If the person engages in behavior that causes significant inconvenience to the guests of the hotel.
⑥ If a Guest makes a violent demand or requests an unreasonable burden to the Hotel or its employees (excluding cases where a Guest requests the removal of social barriers pursuant to the provisions of Article 7 Paragraph 2 or Article 8 Paragraph 2 of the Act on Promotion of Elimination of Disability Discrimination (Act No. 65 of 2013, hereinafter referred to as the "Disability Discrimination Elimination Act").
⑦ Under Article 5-6 of the Hotel Business Act Enforcement Regulations, requests are made to the Hotel or its employees that are an excessive burden to implement and that are likely to significantly impede the provision of accommodation-related services to other guests. (7) When the case falls under the provisions of the Prefectural Ordinance for Enforcement of the Inns and Hotels Act of the prefecture having jurisdiction over the Hotel.

If the Hotel does not comply with the request to enter into an Accommodation Contract in accordance with the preceding paragraph, a Guest seeking accommodation may request an explanation from the Hotel for the reason.

Guest's Right to Cancel Accommodation Contract

Article 8

1.
Guests may cancel their accommodation contract by notifying the hotel.
2.
If the Guest cancels the accommodation contract in whole or in part due to reasons attributable to the Guest (in accordance with the provisions of Article 3, Paragraph 2), the Hotel shall specify the due date for the payment of the application fee and make the payment. (excluding cases where the guest cancels the accommodation contract before the payment is made), the guest will be charged a penalty fee as listed in Attached Table 2. However, in the event that the Hotel accepts the special agreement set forth in Article 4, Paragraph 1, in accepting the special agreement, the Hotel will notify the Guest of the obligation to pay a penalty fee in the event the Guest cancels the accommodation contract. 3.
If the guest does not arrive by 8:00 p.m. on the day of the stay (if the expected time of arrival has been specified in advance, 2 hours after that time) without contacting the hotel, the hotel will The accommodation contract may be treated as having been canceled by the guest.

Our hotel's right to cancel the contract

Article 9

1.
The hotel may cancel the accommodation contract in the following cases. However, this paragraph does not mean that our hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.

(1) When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws and regulations, public order or good morals in regard to his/her accommodation, or when he/she is deemed to have conducted such conduct.
(2) When the guest is a patient of a specific infectious disease.
(3) When accommodation is not possible due to reasons caused by force majeure such as natural disasters.
(4) When the Guest smokes in bed, tampers with fire-fighting equipment, or fails to observe any other prohibited activities stipulated by the Hotel (limited to those necessary for fire prevention).
(5) When the Guest is found to fall under any of the following ① to ⑧.

① If the person is an organized crime group or a person affiliated with an organized crime group, etc.
② If the organized crime organization or a person related to an organized crime organization is a corporation or other organization that controls business activities.
③ In the case of a corporation whose officers (referring to directors, executive officers, or similar persons), employees, affiliated companies, etc. are affiliated with organized crime groups, etc.
④ If the person allows his/her name to be used by organized crime groups, etc.
⑤ If the person engages in behavior that causes significant inconvenience to the guests of the hotel.
⑥ If the Guest makes violent demands or requests an unreasonable burden to the Hotel or its employees (excluding cases requesting the removal of social barriers pursuant to the provisions of Article 7 Paragraph 2 or Article 8 Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities).
⑦ Under Article 5-6 of the Hotel Business Act Enforcement Regulations, requests are made to the Hotel or its employees that are an excessive burden to implement and that are likely to significantly impede the provision of accommodation-related services to other guests. ⑧ In the event of violation of these terms and conditions or other usage rules, etc.

(6) When the cases fall under the provisions of the Hotel Business Law Enforcement Ordinance of the prefecture that has jurisdiction over our hotel.

When the Hotel has cancelled the Accommodation Contract in accordance with the preceding paragraph, it shall not charge the Guest any fees for any accommodation services etc. which he/she has not yet received.
3.
If the Hotel cancels the Accommodation Contract pursuant to Paragraph 1, the Guest may request an explanation of the reason.

Registration of accommodation

Article 10

1.
Guests must register the following information at the front desk of our hotel on the day of their stay.

(1) Name, address and contact information of the guest
(2) For foreigners who do not have an address in Japan, nationality and passport number
(3) Other matters deemed necessary by the hotel.
2.
If the Guest intends to pay the charges set forth in Article 14 using a method that can be substituted for currency, such as an accommodation voucher or credit card, the Guest must present these in advance at the time of registration as set forth in the preceding paragraph.

Room usage time

Article 11

1.
Unless otherwise specified in the accommodation plan, the guest may use the guest room at the hotel until the time specified by the hotel. However, if you stay for consecutive nights, you can use it all day except for the day of arrival and the day of departure.
2.
Notwithstanding the provisions of the preceding paragraph, the hotel may accept use of guest rooms outside of the hours specified in the same paragraph. In this case, additional charges determined by the hotel will be charged.

Compliance with usage rules

Article 12

1.
While in the Hotel, Guests must observe the usage regulations (including usage guidelines, notices, notices, etc.) established by the Hotel and posted throughout the Hotel.

The business hours of the hotel's main facilities are as follows, and detailed business hours of other facilities will be announced in the pamphlets provided, on notices in various places, and in the hotel information guide in guest rooms.

The hours listed in the preceding paragraph may be changed temporarily if necessary. In that case, we will notify you by an appropriate method.

Payment of fees

Article 14

1.
The breakdown of the accommodation charges, etc. to be paid by the guest and the method of calculation thereof are as listed in Attached Table 1.
2.
Accommodation charges, etc. as stated in the preceding paragraph shall be paid in currency or by alternative means such as accommodation vouchers or credit cards approved by the Hotel at the front desk upon departure of the Guest or when requested by the Hotel.
3.
Even if the guest voluntarily chooses not to stay or use the room after the hotel has provided the guest room to the guest and the guest is able to use the room, the accommodation fee will still be charged.

Our hotel's responsibilities

Article 15

1.
The Hotel shall compensate the Guest for damages caused to the Guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements, unless such damages have been caused by reasons beyond the Hotel's control.

Handling when the contracted room cannot be provided

Article 16

1.
When the Hotel is unable to provide a contracted room to a Guest, it will, with the Guest's consent, arrange accommodation of similar standards elsewhere for the Guest, wherever possible.
2.
If the hotel is unable to arrange other accommodations despite the provisions of the preceding paragraph, the hotel will pay the guest a compensation fee equivalent to the penalty, and the compensation fee will be applied to the amount of damages. However, if there is no reason attributable to the hotel for the inability to provide a guest room, no compensation fee will be paid.

Handling of deposited items, etc.

Article 17

1.
When loss, breakage or other damage occurs to goods, cash or valuables deposited at the front desk by the guest, the hotel shall compensate for such damage, except in cases where such loss or breakage is due to acts of God. However, in the case of cash and valuables, if the hotel requests a declaration of their type and value and the guest fails to do so, the hotel shall compensate for such damage up to a maximum of 150,000 yen.
2.
The Hotel shall compensate for damages incurred when loss, breakage or other damage occurs due to the Hotel's intention or negligence regarding goods, cash or valuables brought into the Hotel by the Guest but not deposited at the Front Desk. However, for items whose type and value have not been reported in advance by the Guest, the Hotel shall compensate for such damages up to a maximum of 150,000 yen, except in cases where the Hotel is responsible for such damages due to the Hotel's intention or gross negligence.

Storage of guests' baggage or personal effects

Article 18

1.
If the guest's baggage arrives at the hotel prior to their stay, the hotel will take responsibility for storing the baggage and hand it over to the guest upon check-in only if the hotel agrees to do so prior to the guest's arrival.
2.
If a guest's baggage or belongings are found left behind at the hotel after checking out, the hotel will, in principle, wait for contact from the owner to inquire and ask for instructions. If there are no instructions from the owner, the hotel will dispose of the items in accordance with the hotel's designated management procedures, in accordance with the Lost Property Act and instructions and guidance from the local police station. Cash and valuables will be turned in to the nearest police station within seven days of the day they are found, and food, beverages, and items that may damage the sanitary environment will be promptly disposed of in accordance with the hotel's designated management procedures.
3.
In the case of the preceding two paragraphs, the hotel's responsibility for the storage of the guest's baggage or personal effects shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 1 of the same Article in the case of the preceding paragraph. The provisions of Section 2 shall apply.

Parking responsibilities

Article 19

1.
When a guest uses Hakkeijima 's parking lot, the hotel rents out the space and does not assume responsibility for the management of the vehicle, regardless of whether the vehicle key is entrusted to the guest. However, if damage is caused intentionally or negligently by the hotel in managing the parking lot, the hotel will be responsible for compensation.

Guest responsibilities

Article 20

1.
If the Hotel suffers damage due to the intentional or negligent act of the Guest, the Guest shall compensate the Hotel for the damage.
2.
Our hotel is completely non-smoking. If smoking (including electronic cigarettes and heated tobacco) is allowed in the guest room, you will be required to pay ¥50,000 as compensation for damages. However, if the actual damage caused to our hotel exceeds the amount, we will ask you to pay the actual amount of damage.

separability

Article 21

1.
Even if a part of these terms and conditions or other usage rules, etc. is determined to be invalid based on laws and regulations, the validity of the provisions other than that part will not be affected.
2.
Even if a part of these terms and conditions or other usage rules, etc. are invalidated or canceled in relation to a particular guest, this shall not affect their validity in relation to guests other than that guest. .

Governing law and language

Article 22

1.
The validity, interpretation, and performance of these terms and conditions and other usage rules shall be governed by Japanese law.
2.
Although these terms and conditions and other usage rules are written in multiple languages, only the Japanese version is acceptable.

Changes to terms and conditions

Article 23

The hotel may revise these terms and conditions if it deems it necessary. In the event that a revision is made, the Hotel shall notify the effect of the change, the content of the revised terms and conditions, and the effective date on the website (https://www .seaparadise.co.jp/hotel/yakkan/).

The basic accommodation fee is based on the hotel's price list.
2.
At our hotel, child rates apply to elementary school students and younger. There is no charge for infants under 3 years of age for whom bedding and meals are not provided. However, child and infant rates may be set depending on the season and accommodation plan. In this case, we will notify you by an appropriate method. If the tax law is revised, the revised provisions shall apply.
